TERMS AND CONDITIONS
These Terms and Conditions ("Agreement") are entered into between Speaker Express ("Speaker Express," "we," or "us") and the customer ("you" or "customer") for the rental of audio equipment and related services in New South Wales, Australia. By renting equipment or services from Speaker Express, you agree to be bound by these terms and conditions.
Rental Period: The rental period begins on the date and time specified in the rental agreement and ends on the date and time the equipment is returned to Speaker Express. The customer agrees to return all rented equipment by the agreed-upon return time.
Rental Fees: The customer agrees to pay the rental fees specified in the rental agreement. Additional charges may apply for late returns, damages, or missing equipment. All fees are subject to Goods and Services Tax (GST) as required by Australian law.
Payment: Payment for rental fees, deposits, and any additional charges are due at the time of booking or upon pick-up of the equipment, unless otherwise agreed upon in writing by Speaker Express.
Security Deposit: Speaker Express may require a security deposit to be paid by the customer at the time of booking or upon pick-up of the equipment. The security deposit will be refunded to the customer upon the return of all rented equipment in good condition, minus any charges for damages, late returns, or missing items.
Equipment Use: The customer agrees to use the rented equipment in accordance with the manufacturer's instructions and only for its intended purpose. The customer is responsible for any damages caused by misuse, neglect, or improper handling of the equipment.
Liability: Speaker Express shall not be liable for any damages, losses, or injuries arising from the use of rented equipment, except where such damages, losses, or injuries are caused by the negligence or willful misconduct of Speaker Express.
Indemnification: The customer agrees to indemnify and hold Speaker Express harmless from any claims, damages, losses, or expenses arising from the customer's use of the rented equipment.
Insurance: It is the customer's responsibility to obtain any necessary insurance coverage for the rented equipment during the rental period.
Cancellation: Cancellations made by the customer may be subject to cancellation fees as specified in the rental agreement. Speaker Express reserves the right to cancel or modify rental reservations at any time.
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising under this Agreement shall be resolved in the courts of New South Wales.
Entire Agreement: This Agreement constitutes the entire agreement between Speaker Express and the customer regarding the rental of equipment and supersedes all prior agreements and understandings, whether written or oral.
By signing below, the customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
PAID DELIVERY TERMS
***Standard delivery presumes Ground or Street level access with open accessibility to the area being delivered to. We deliver curb side unless Setup is paid for!!
HOW IT WORKS - WE DELIVER IN ONE TO TWO HOURS AFTER ORDERING UNLESS YOU CHOOSE EXPRESS DELIVERY WHICH WILL BE IN LESS THAN AN HOUR TRAFFIC PERMITTING…. WE THEN GIVE YOU A TWO HOUR WINDOW FOR PICKUP THE NEXT DAY 24 HOURS AFTER YOUR HIRE BEGAN.
Please note.... extra charges WILL apply for:
Difficult delivery locations with loading docks and/or limited street parking
Deliveries that have stair access only
Deliveries that may require more than one person for a setup
Deliveries that are required in less than an hour
Deliveries that are after our normal hours of operation
Deliveries that are outside our normal delivery areas. For basic reference check out our delivery area on the website.
TIME SPECIFIC PICKUP AND DROP OFF
When you pay for sub one hour or express delivery or for time specific pickups and drop offs we will always endeavour to be at your nominated location at the stated time and we will give you a contact for your driver so you can communicate with them directly.
Pickups or drop offs after 10pm and before 10am Mon-Sun, are classified as after hours pickups and incur an extra MINIMUM $100 charge. The cost of the delivery or pickup are based on the amount of items at pickup or drop off.
For pickups after your hire is completed we will give you a 2 hour window for pickup… if you don’t think you will be home please choose the time specific pickup fee at checkout
*** please note, if you are not contactable or available at the time of agreed delivery, you may miss your delivery window and have to re-book - this will incur a $50 minimum fee
OUT OF HOURS
Please note... there are extra charges that will apply for any out of hours delivery, setup or delivery return. The cost of the delivery or pickup are based on the amount of items at pickup or drop off.
Our normal operating hours are as follows: Mon-Sun 10am-10pm, if you wish to return out of hours, this can be arranged PRIOR to the day you wish to return.
Please note, there is a minimum $100 surcharge if you wish for us to pickup or return out of hours and this must be paid in advance or at the time of booking.
